DB Wire Story Licence

This licence is between The Defense Brief, Toronto, Ontario, Canada (info@defensebrief.ca) and the buyer of a DB Wire story. You accept it by ticking the acceptance box before checkout. The version you accept is recorded with your licence. It works together with our Terms of Use.

1. The Licensee

If you buy while acting for an organization, the licensee is that organization. Otherwise the licensee is you personally. The licence cannot be transferred.

2. The Licensed Work

The licensed work is the story identified on the listing — its text as delivered after purchase, together with its headline and references. It does not include photographs, graphics or third-party material unless the listing says so, or underlying facts, which no one owns.

3. What You May Do

Worldwide and for as long as the licence stands, you may publish the licensed work in the media ticked on the listing and on your licence (web, social media, newsletter, print), with the attribution shown on your licence, and after any embargo shown has passed. You may edit it only if the listing says editing is allowed; otherwise you may make only minor changes of style and length that do not alter its meaning.

4. What You May Not Do

• sublicense, resell or syndicate the work to others;
• publish it in media not ticked on your licence, or before its embargo ends;
• remove the attribution or present the work as written by someone else;
• change it in a way that alters its meaning or misrepresents its sources.

5. Standard and Exclusive Licences

• Standard: others may also license the same story, up to any cap shown on the listing.
• Exclusive: from the time of purchase, we will not license the story to anyone else. If the listing states an exclusivity window (for example, 24 hours), exclusivity lasts for that window, after which the story may be offered under standard licences; your own licence continues.

Exclusivity covers licensing through DB Wire. It does not prevent the underlying facts being reported by others, or The Defense Brief from referring to its own reporting.

6. Price, Taxes and Payment

The price is shown in Canadian dollars on the listing before checkout. No sales tax is currently charged. Payment is processed by Stripe.

7. Refunds

Licence purchases are non-refundable once the licence is granted, except:

• if we cannot grant the licence you paid for — for example because an exclusive was already sold — we refund you automatically;
• if we revoke a licence you bought (for example, to correct a serious error or respond to a legal claim), we refund you in full and tell you why;
• where the law gives you a right to a refund.

8. Corrections and Withdrawals

If we correct a licensed story, we will send the correction to the licensee and you agree to publish it, or remove the story, within a reasonable time. If a story must be withdrawn for legal reasons, we will tell you and you agree to take it down; we will refund you as set out in section 7.

9. Our Assurances

We have the right to grant this licence. We prepare stories with care, but they are journalism about fast-moving events and are licensed as delivered. Our liability under this licence is limited as set out in section 12 of the Terms of Use, and in any case to the price you paid for the licence, subject to rights that cannot be excluded by law.

10. Signed Agreements Prevail

If your organization has a signed agreement with us covering DB Wire, that agreement prevails over this licence where they conflict.
